Regina M. Foley

Committed to serving others through the law, Regina Foley is a passionate advocate for victims of negligence. She has served as trial co-counsel in a variety of complex civil cases, including medical malpractice, product liability, trucking accidents and other forms of negligence. She has earned an exceptional track record in helping her clients. In fact, she is an AV Preeminent Peer Rated Attorney by Martindale-Hubbell, has been consistently selected to the Pennsylvania Super Lawyers list since 2011, and has been designated as one of the top fifty women attorneys in Pennsylvania since 2017. Early in her career, she was one of 30 attorneys recognized by the Legal Intelligencer and The Pennsylvania Law Weekly in the inaugural edition of “Lawyers on the Fast Track,” honoring both her legal skills and her community service.

Ms. Foley is committed to giving back to her profession. She is actively involved in the leadership of several organizations including the Philadelphia Bar Association where she is a past Chair of the Board of Governors, past Chair of Women in the Profession Committee, and the past Treasurer; the Philadelphia Trial Lawyers Association where she serves as a member of the Board of Directors; and the Pennsylvania Bar Association where she serves as a member of the House of Delegates. She is a frequent lecturer on a range of topics, including civil litigation, deposition techniques, evidence and work-life balance.

Giving back and involvement in the community are also part of Ms. Foley’s fabric. She is a volunteer with the Support Center for Child Advocates, with whom she has continually maintained active cases for more than eighteen years. She was honored by the Support Center as a 2017 Distinguished Advocate for her pro bono efforts on behalf of abused and neglected children. Recognizing Ms. Foley’s exemplary pro bono work, the Judges of the First Judicial District of Pennsylvania have included Ms. Foley in their Pro Bono Roll of Honor. She was appointed to the Board of The Pennsylvania Legal Aid Network (PLAN) in 2019, a statewide consortium of independent legal aid programs which coordinates the delivery of civil legal assistance to Pennsylvanians who need it most. In 2020, she was elected Treasurer of PLAN. Beyond the legal community, she served for 17 years on the pastoral council of her church and has served and remains active with the Advisory Board of the Sisters of Saint Joseph Welcome Center focusing on the needs of the immigrant community in Philadelphia’s Kensington section.

Ms. Foley is a lifelong resident of Flourtown, PA where she and her husband are the proud parents of three sons.

Confidential Multi-Million Dollar Settlement for Fatal Truck Accident
As traffic on the highway slowed to a stop because a tractor trailer had tipped over a few miles ahead, an inattentive truck driver crashed into the back of a commuter’s car, killing the driver. The trucker’s employer had only one-million dollars in insurance, which was woefully inadequate to compensate the driver’s family for their loss. Regina Foley led the investigation into the accident and developed the evidence to hold the tractor trailer that had tipped over responsible for creating the conditions which inevitably led to the accident. Working with traffic engineers and using traffic flow reports, Ms. Foley was able to create a computer model that demonstrated how the traffic rapidly built up during rush hour behind the overturned truck. As the tie-up moved backwards, it accelerated, reducing the braking distance for the trucker who hit the car. By creating a video settlement brochure, the family’s grief was powerfully conveyed before trial. At mediation, a confidential multi-million dollar settlement – several times more than the limits of coverage for the striking trucker – was achieved which secured the family’s financial future.

$7,400,000 verdict under the Federal Tort Claims Act
A troubled veteran under psychiatric care at a Veterans Administration treatment facility was released, and tragedy followed: he murdered two of his children and two of their friends, followed by the veteran’s suicide. The children’s mothers asked Raynes McCarty to hold the government accountable for their losses. Regina Foley developed the evidence to establish that the Veterans Administration was grossly negligent, the standard of proof required by the Mental Health Procedures Act. The case was tried to a federal judge, sitting non-jury, who concluded that the VA was grossly negligent and awarded damages that honored the lives lost.

$4,200,000 Settlement for Baby Injured at Birth
After a normal pregnancy and normal fetal monitoring for more than nine hours, baby Ella began to show signs of deterioration. As labor progressed the signs became more obvious that there could potentially be issues with this delivery and baby Ella’s oxygenation. Despite a prolonged late deceleration requiring fetal resuscitation as well as a non-reassuring fetal heart rate tracing, medical personnel failed to recognize the severity of the situation and baby Ella was born limp with no heart rate. Regina Foley prepared the case for trial and retained a team of medical experts to testify that the nursing staff and attending obstetrician failed to appropriately respond to the signs of fetal distress, improperly administered Pitocin, and should have delivered the distressed baby by emergency caesarian section. The birth asphyxia caused by these failures led to permanent brain damage for baby Ella. Regina Foley successfully resolved the case on behalf of Ella and her parents at mediation for $4,200,000.

$3,800,000 Pre-Suit Settlement for Closed-Head Injury
After 71-year-old Terry was seriously injured when his vehicle was struck by a tractor-trailer, he and his wife turned to Raynes McCarty for help. Tim Lawn and Regina Foley led the Raynes McCarty team who took on the out-of-state trucking company. Terry had a remarkable physical recovery from his orthopedic injuries, but continued to suffer from the effects of the closed-head injury. Because the effects on short term memory and cognitive processing were not noticeable during short interactions, Lawn and Foley completed video interviews of friends and family, who could vividly describe the changes in Terry. Once it received the video settlement presentation, the trucking company requested mediation even before suit was filed. The case resolved for $3,800,000.
