A. Roy DeCaro

Roy DeCaro has tried more than 200 jury trials to verdict during his legal career, first as a prosecutor and now as a civil attorney. He has achieved on behalf of his clients over a dozen verdicts in excess of $1,000,000.00, and two verdicts in excess of $10,000,000.00. So, it is little surprise that Best Lawyers® recognized Mr. DeCaro in 2018 as the “Best Personal Injury Lawyer of the Year” for Philadelphia.

Roy has been selected to the Super Lawyers Top 100 list for over 20 years and has been selected to the Top 10 Super Lawyers in Pennsylvania list on two occasions. He was named by “Lawdragon” Magazine as one of the 500 best lawyers in the United States. Roy has regularly been selected by his peers for inclusion in The Best Lawyers in America© – twice named as best Philadelphia civil plaintiff lawyer.

As a prosecutor, he persuaded juries to convict murderers, drug dealers, motorcycle gang members, organized crime figures, corrupt police officers and corrupt public officials. As a civil trial lawyer, Roy has represented those who have been seriously injured or killed by others’ negligence, including those injured due to medical error, unsafe products, and negligent drivers. These cases have contributed to improve safety measures in America.

He often asked to mediate and arbitrate cases by plaintiff and defense lawyers. During the Covid-19 pandemic, he has been conducting these mediations and arbitration using Zoom. He has been called upon to serve on blue-ribbon panels including panels to recommend institutional changes in the Philadelphia Police Department and the Philadelphia Criminal Court System. He has been an Adjunct Law Professor at Villanova Law School teaching Evidence four times. He was the 2018 and 2019 President of the Philadelphia Trial Lawyers’ Club – an organization that aids lawyer in distress and promotes civility. He does extensive pro bono work.

Roy is a member of the International Academy of Trial Lawyers, the American College of Trial Lawyers and the American Board of Trial Advocates.

In his free time, he loves to hunt, fish, garden and spend time with his family – especially his two grandsons.

$24,000,000 Confidential Settlement for Construction Site Accident
As the operator of a large piece of construction equipment sat down in the cab, he unintentionally moved the joystick control, causing the boom to swing uncontrollably and knock a piece of equipment onto a young man standing nearby.  The worker became a quadriplegic.  The Raynes team, led by Roy DeCaro with significant assistance of Dan Bencivenga and Marty Brigham, established that the excavator manufacturer’s design violated international safety standards, ignored safety alerts from its country’s OSHA, and lacked a commercially available alternate design that would have prevented the injury.  After jury selection had been completed, the defendants settled for $24,000,000.00.

$10,250,000 Verdict in Swimming Pool Accident
Richard dove from a wooden deck into a backyard, aboveground swimming pool, not understanding its shallow depth. He struck his head on the bottom and was paralyzed. Raynes McCarty sued the manufacturer of the pool liner on Richard’s behalf, because the liner had neither adequate depth markers nor warnings against diving. At trial, Roy DeCaro convinced a federal jury to return a $10,250,000 verdict in favor of our client. In response to the verdict, swimming pool manufacturers improved their warnings about the dangers of diving into these pools.

$5,700,000 Verdict in Fatal Car Crash
Florence Gormley was killed in a car crash when a van driven by a Choice Courier employee skidded into her. Roy DeCaro convinced a federal court jury to award $1.8 million in compensatory damages for this homemaker, even though she had never worked outside of her home. The jury also awarded $3.7 million in punitive damages because the company’s vans had bald tires, which it had neither inspected nor corrected.

$3,800,000 Verdict in Delaware County for Failure to Treat Sepsis
Janice died as the result of an overwhelming sepsis infection after being in Riddle Memorial Hospital for 14 hours. Over a seven day jury trial, Roy DeCaro convinced the Delaware County jury that Janice’s doctors should have acted more quickly to save her life. The jury awarded $3,800,000 to the family, one of the largest awards ever in this County for medical malpractice.
